What Are Divorce Settlements?

The National Center for Health Statistics reported that in 2014 there were 813,863 divorces that were granted in the United States.

While many individuals going through divorce may be tempted to handle divorce themselves rather than retaining a divorce attorney for financial reasons, most couples decide to retain attorneys to ensure their best possible outcome.

Often, people hire divorce lawyers because there are complex issues that need to be addressed, and an experienced attorney deals with these issues every day.

Divorce settlements, often reached with the aid of an attorney, are agreements between couples that establish the terms of a divorce.

These settlements are sought by couples who do not want a judge to decide their future.

Why would a couple agree to a divorce settlement? There are a few reasons:

Avoid Court. A well-drafted divorce settlement often prevents couples from having to go to court and have a Judge decide the terms of a divorce. As a result, divorce settlements can save a significant amount of time.

Flexibility. Divorce settlements allow couples to create more specific and detailed settlements than a judge may decide. This flexibility allows a divorcing couple to establish the terms of a divorce to ensure that the results reached are the best for each spouse/ family. As a result, a divorce settlement offers a great amount of control in the process

Less Tension. Divorce settlements often enable couples to heal and return to normalcy sooner than a high-tension divorce in court. Divorces in court can be adversarial, pitting spouses against each other thereby substantially delaying the healing process. As a result, divorce settlement agreements can be beneficial to the emotional health of a divorcing couple and their children

Financial Concerns. If spouses can work together to obtain a divorce settlement rather than go to court, the couple can often save thousands of dollars in attorney fees and costs.

Not Easily Changed. Once a divorce settlement is finalized and approved by a court, a spouse who becomes dissatisfied with the terms of the divorce cannot usually change the agreement at a later date, unless it is explicitly stated in the agreement that it can be modified. An executed divorce settlement can also be changed if substantial assets were not established at the time that the settlement was being drafted.
