Child Custody and Visitation (Parenting Plans)

Child Custody Lawyer - Rebecca M. Medina

Child Custody and Visitation Attorney in Fresno and San Diego, California

When a marriage or relationship ends, couples who have minor children together will need to make custody and co-parenting arrangements. They’ll need to consider how much time the children live or spend with each parent, and how to go about raising them after separating from each other. These very important decisions can either be decided by the parents if they are in agreement, a private mediator to aide the parents in reaching an agreement, or if necessary a Family Law Judge.

Your children are your number one priority and any decisions involving them should never be taken lightly. Rebecca Medina is experienced in matters related to visitation, and she can help you reach an agreement that works best for your family.

Sorting it Out

If parents agree over custody and visitation, this transition can go smoother. However, usually there is need for a private mediator to help parents reach a legal agreement, or even a family law judge to make a ruling. Rebecca Medina understands that your children are your top priority, and can assist you in the mediation and court filing process to achieve the best possible outcome.

Factors to Consider

Courts in California consider many factors when working through the custody and visitation arrangements of each case. There are different ways that your agreement could be structured, but yours will likely be set up as some combination of:

  • Sole legal custody
  • Joint legal custody
  • Sole or Joint Physical custody with visitation

In sole legal custody agreements, one parent has the right to make decisions about their children’s education, health, and welfare. Joint legal custody means that both parents have the right to make these decisions together.

In joint custody arrangements, children may split their time living with each parent 50/50, or some other percentage that better suits the family. If drug or alcohol abuse, parental absenteeism or mental disorders are present, the court may not grant any custodial rights or visitation to one parent.

Rebecca help me through a very difficult time. She stood up and and gave me a voice in court when no one else could. She knew the law and gave me information about my rights and responsibilities as a parent. She even spent time after hours working on my case. In my opinion Rebecca is an outstanding lawyer as well as a person.
