Factors to Consider

Courts in California consider many factors when working through the custody and visitation arrangements of each case. There are different ways that your agreement could be structured, but yours will likely be set up as some combination of:

  • Sole legal custody
  • Joint legal custody
  • Sole or Joint Physical custody with visitation

In sole legal custody agreements, one parent has the right to make decisions about their children’s education, health, and welfare. Joint legal custody means that both parents have the right to make these decisions together.

In joint custody arrangements, children may split their time living with each parent 50/50, or some other percentage that better suits the family. If drug or alcohol abuse, parental absenteeism or mental disorders are present, the court may not grant any custodial rights or visitation to one parent.
